TDA Opposes Amendment to Allow Arbitration of Certain Charges Against Them and Opposes Arbitration Against TD Ameritrade Clearing
In the last hearing, TDA convinced the Arbitrator to rule that TD Ameritrade Clearing is a separate entity from TD Ameritrade and must be added as a Defendant. Then, when they receive the motion they requested, they turn around oppose it on the basis that the Plaintiff should have known that they were different legal entities!
The fact that they are the same legal entity is demonstrated by the following:
The two share very similar names,
They have the same physical address registered with FINRA
They have the same President. Call the office of the President and ask for the President of each entity. You'll find it is the same person.
They do not maintain records of financial transactions between them, and
They use the same legal staff.
TDA is trying to play on an arbitrator's lack of reasoning ability. The risk here is that Mr. McLaren may be intelligent and pick up on their strategy to make him look foolish and play him into making the arbitration slow and expensive. Will the Arbitrator let himself be deceived by the big bank?
